Preamble Powergram is a service offered by AP Développement (hereinafter "Powergram"), a company registered in France and located at 18 rue Gabriel Péri, 83120 Sainte-Maxime. Powergram provides services aimed at improving visibility and acquiring qualified clients on Instagram through automation methods (hereinafter referred to as the "Services"). Powergram reserves the right to modify the list of services and their terms of sale at any time; the applicable general terms of sale being those in effect at the time of the order.

1. Description of the Services

Powergram offers the following services:

• Analysis and targeting of qualified audiences based on specific criteria.

• Automation of interactions (likes, likes and story interactions).

• Continuous optimization of campaigns to ensure effective results.

• Detailed reporting on the results achieved.

The services are tailored to the needs of each client and are provided in compliance with Instagram's platform usage policies.

2. Scope of Application

The present General Terms and Conditions of Sale (GTCS) govern the contractual relations between Powergram and its clients (hereinafter "the Client") within the framework of providing the services. By subscribing to Powergram's services, the Client unconditionally accepts these GTCS.

3. Prices and Payments

• Prices: The prices of Powergram services are indicated in euros excluding VAT (HT). The applicable prices are those in effect at the time of the order.

• Payment:

  • The payment validates the activation of the services.

  • Accepted payment methods: credit card via a secure solution, bank transfer or SEPA direct debit.

  • No refunds will be made after the activation of the services.

4. Commitments and Renewal

• The services are subscribed for a fixed term (3, 6 or 12 months), chosen at the time of the order.

• At the end of this period, the subscription is automatically renewed by tacit agreement for an equivalent duration, unless terminated by the Client with 30 days' notice before the end of the term.

• No refunds or early terminations are possible during the commitment period.

5. Activation of Services

• The activation of Powergram services is carried out after payment validation and receipt of the Instagram credentials provided by the Client.

• The Client is responsible for providing valid credentials and ensuring that their account complies with Instagram's terms of use.

• Powergram disclaims any liability in the event of suspension or restriction of the Client's Instagram account by the platform.

6. Responsibilities

• Powergram commits to providing the services as described in these GTCS and to adhering to best practices in automation.

• The Client is responsible for the use of the services and the results obtained.

• In no event shall Powergram be held liable for the consequences of improper use of the services or for restrictions imposed by Instagram.

7. Confidentiality and Data Protection

• Confidentiality: Powergram commits to ensuring the confidentiality of the information exchanged with the Client.

• Data Protection: The Client's personal data is processed in accordance with the GDPR. The Client can exercise their rights of access, correction, or deletion of their data by contacting Powergram at the following address: contact@powergram.ai.

8. Disputes

• Amicable Settlement: In case of a dispute, the parties agree to seek an amicable solution before any legal action.

• Competent Jurisdiction: In case of persistent disagreement, any dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Sainte-Maxime.

9. Final Provisions

These GTCS constitute the entirety of the agreement between Powergram and the Client. Any modification of the GTCS must be accepted by both parties in writing.
